Litigation is intimidating and expensive. It also takes a considerable amount of time and usually requires the services of an attorney, along with the expense of the lawyer. The rules for arbitration adopted by the AAA (American Arbitration Association) allow for a faster and easier process. You save time and money and have a decision that binds both parties and is enforceable in state and federal courts.
The world of alternative dispute resolution has permeated most business and consumer contracts with arbitration agreements. Mediation may be a process that helps you resolve conflicts faster and less expensive than formal litigation. Selecting an experienced arbitrator or mediator may seem scary. YH Strategies provides a dispute mediation service that is based on objective and fair analysis of the law and facts to find a just and fair outcome to a dispute.
We can help you determine whether your dispute can be arbitrated or mediated, and provide the trained professional to oversee the arbitration or mediation of your matter.
An Arbitration starts with an arbitration agreement that acknowledges that a dispute will be heard by an appointed arbitrator. The setting may look similar to a courtroom. A court reporter may be present and typical courtroom rules are set aside. Sworn testimony and all relevant evidence is considered by the Arbitrator. For consumer matters, the process is shorter with simpler rules, and lower costs than traditional litigation.
Mediation is a dispute resolution process that includes all interested parties who have expressed a willingness to find a solution to a problem or to answer a critical question. The mediator plays a neutral role in helping the parties settle their differences.
